Ancillary Estates

If your loved one was a resident of another state, but owned property in Tennessee, you may be required to open a probate in Tennessee. This is called an ancillary estate.

If probate has already been opened in another state, ancillary estates are required to transfer a decedent’s real and/or personal property in Tennessee to the beneficiaries or heirs-at-law. The out-of-state probate court provides exemplified documents for a fee to the county Probate Court in Tennessee, which are then used to open a simultaneous probate for the purpose of transferring the probate assets in Tennessee.
